1. Definitions

“Payload Performance”, “we”, “our”, or “us” means MRTP GROUP PTY LTD trading as Payload Performance.

“Customer” means the vehicle owner or authorised representative requesting services.

“Vehicle” means any vehicle delivered to Payload Performance for inspection, supply, installation, modification or related services.

“Services” include mining and civil vehicle fitouts, GVM upgrades, accessory installations, vehicle protection systems, dealership work, project management and full vehicle builds.

2. Acceptance of Terms

By requesting a quote, paying a deposit, delivering a vehicle, or authorising work, the Customer agrees to these Terms & Conditions.

These Terms apply to all work performed unless otherwise agreed in writing.

3. Scope of Services

Payload Performance provides:

  • Mining & Civil vehicle fitouts
  • GVM / NB1–NB2 upgrades (pre & post registration)
  • Vehicle protection installations
  • Full vehicle builds & project management
  • Dealership vehicle preparation
  • Accessory installation including lights, snorkels, UHF systems and related equipment

All work is performed using parts supplied exclusively by Payload Performance for quality control and warranty consistency.

4. Quotes & Estimates

4.1 Quotes are estimates based on information supplied by the Customer.

4.2 Quotes remain valid for 30 days unless otherwise stated.

4.3 Additional costs may arise where:

  • incorrect information is provided
  • hidden damage or faults are discovered
  • additional labour or components are required

Customers will be notified prior to proceeding where practicable.

5. Website Pricing & Online Errors

5.1 While we take reasonable care to ensure that pricing, product descriptions, specifications, images and availability shown on our website are accurate, errors may occur from time to time.

5.2 Such errors may result from, but are not limited to:

  • Technical faults, software bugs, or website outages
  • Typographical or data-entry errors
  • Errors in automated pricing, product imports, or third-party apps and integrations
  • Incorrect display of prices, taxes, or fitting/installation components
  • Currency, discount, or rounding display errors

5.3 All prices and information displayed online are subject to change without notice and do not constitute an offer to sell at that price. An order placed through our website is an offer by the Customer to purchase, and no binding contract is formed until Payload Performance has accepted and confirmed the order in writing.

5.4 Where a product or service is listed at an incorrect price, or with incorrect information, Payload Performance is not obligated to supply at that price and reserves the right to:

  • Correct the error and notify the Customer
  • Cancel or decline the affected order, whether or not it has already been accepted
  • Cancel and refund an affected order after payment has been made

5.5 Where a pricing or product error is identified after an order has been paid, we will contact the Customer and offer the choice to either:

  • Proceed with the order at the correct price, or
  • Receive a full refund of any amount paid for the affected item

5.6 Nothing in this clause limits or excludes any guarantee, right, or remedy the Customer has under the Australian Consumer Law.

6. Deposits & Ordering

6.1 A 50% deposit is required before any parts are ordered or work scheduled.

6.2 Deposits authorise Payload Performance to procure parts and allocate workshop time.

6.3 If a Customer changes products before installation:

  • Returns are subject to supplier approval
  • Freight and supplier restocking fees may apply
  • Applicable costs will be deducted from the deposit before any refund

7. Payments & Vehicle Release

7.1 Full payment must be received and cleared before vehicle collection.

7.2 Vehicles remain under the possession and control of Payload Performance until payment is received in full.

7.3 Direct deposit payments must clear prior to release.

8. Storage Fees

Due to limited workshop space:

  • Vehicles not collected within the agreed timeframe may incur a storage fee of $100 per day.
  • Collection timelines are discussed at drop-off and estimate stage.

9. Parts Supply & Manufacturer Responsibility

9.1 Payload Performance installs only parts supplied by Payload Performance.

9.2 Manufacturer warranties apply to supplied products.

9.3 Payload Performance is not responsible for:

  • Manufacturer defects
  • Freight damage
  • Supplier delays
  • Backorders or supply chain disruptions

We will, however, use reasonable efforts and supplier relationships to assist customers in achieving resolution outcomes.

10. Vehicle Handling & Test Driving

10.1 Vehicles are stored within a gated private property monitored by 24/7 security surveillance.

10.2 Vehicles may be test driven by fully licensed and insured employees for purposes including:

  • Quality control
  • Wheel alignment verification
  • Safety confirmation
  • Post-installation testing

11. Workmanship Warranty

11.1 Payload Performance provides a 12-month workmanship warranty only where the vehicle returns for its scheduled 500km Quality Control inspection.

11.2 Product warranties are determined solely by the manufacturer.

11.3 Payload Performance will assist customers in warranty claims where possible.

Warranty Exclusions

Workmanship warranty does not cover:

  • Off-road damage
  • Mining or civil operational wear
  • Overloading or misuse
  • Lack of maintenance
  • Work modified or altered by another workshop
  • Manufacturer product failures

12. GVM Upgrades & Legal Compliance

12.1 Payload Performance installs only certified GVM upgrade kits.

12.2 Customers are provided required certification documentation.

12.3 Responsibility for lawful vehicle operation rests solely with the driver and vehicle owner.

Payload Performance is not responsible for:

  • Driver misuse
  • Operating outside legal limits
  • Failure to understand applicable vehicle laws
  • Legislative differences between states or jurisdictions

13. Customer Responsibility

The Customer acknowledges responsibility for:

  • Operating the vehicle within legal load limits
  • Ongoing maintenance
  • Compliance after delivery
  • Any modifications made after Payload Performance completes work

14. Cancellation & No-Show Policy

14.1 Customers must provide reasonable notice if unable to attend scheduled bookings.

14.2 Payload Performance will attempt reasonable accommodation.

14.3 Where insufficient notice or no reasonable explanation is provided, Payload Performance may retain part of the deposit to cover incurred costs and lost workshop allocation.

15. Limitation of Liability

To the extent permitted by law, Payload Performance is not liable for:

  • Pre-existing vehicle faults
  • Electrical or mechanical failures unrelated to installed components
  • Hidden defects discovered during installation
  • Consequential losses including downtime or business interruption
  • Damage arising from vehicle use outside intended purpose

Nothing in these terms excludes rights under Australian Consumer Law.

16. Australian Consumer Law

Goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where permitted, Payload Performance limits remedies to:

  • Repair
  • Replacement
  • Resupply of services

17. Media & Marketing Consent

Payload Performance may photograph or record vehicles for marketing purposes including website, social media and promotional materials.

  • Registration plates will generally be obscured where practical
  • Customer names will not be disclosed
  • Vehicle branding may appear unless the Customer requests otherwise in writing prior to publication

18. Interstate Compliance

While work performed complies with Queensland legislation at time of completion, interstate laws may differ or change.

Payload Performance accepts no responsibility for regulatory differences outside Queensland.

19. Dispute Resolution

Parties agree to attempt good-faith resolution prior to commencing legal proceedings.

20. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.
